Beyond Monogamy: What West Hollywood's Multi-Partner Ordinance Means and Where Polyamory and Polygamy Stands Globally

When news broke that West Hollywood, California, passed a law allowing multi-partner relationships such as throuples (three people) and foursomes (four people) to register for domestic partnerships, headlines quickly began spreading confusion.
Did a city in California just legalize three-way marriage? Is polyamory illegal everywhere else? And how does this compare to countries where men can legally have multiple wives?
Here is a clear, step-by-step breakdown of how relationship law actually works in the United States and around the world.
1. The Global Reality: Polyamory Versus Polygamy
To understand the legal landscape, it is essential to distinguish between two terms that are frequently confused: polygamy and polyamory.
Polygamy: Legal in About 58 Countries, But It Is Not Polyamory
As of 2026, polygamy, specifically polygyny where one man marries multiple women, is legally recognized in roughly 58 out of nearly 200 sovereign nations. These are predominantly Muslim-majority countries across Africa, the Middle East, and parts of Asia, including nations like Saudi Arabia, Nigeria, the United Arab Emirates, Egypt, and Indonesia.
However, these traditional and religious marriage systems operate very differently from modern polyamory:
One-Sided Structure: It is almost exclusively one man with two to four wives. The wives are each legally married to the husband, but they are not married to each other.
Lack of Gender Reciprocity: Polyandry, one woman with multiple husbands, is illegal almost everywhere worldwide. While Gabon allows it on paper, in practice the right to multiple spouses is reserved strictly for men.
Hierarchical Legal Framework: The legal center of the family is the husband under religious or customary law, such as Islamic Sharia, rather than a shared civil partnership contract between equals.
A multi-gender egalitarian group, such as two men and one woman who are all equal partners to each other, would not be recognized as a valid marriage under polygamy laws in Saudi Arabia, Egypt, or Nigeria.
Polyamory: Recognized as Full Marriage in Zero Countries
An egalitarian polyamorous relationship is one where all partners stand as equal, mutual spouses, like a three-way civil marriage.
Currently, no country in the world grants full state-level or national marriage rights to polyamorous unions in the same way they do for two-person marriages.
While a few nations have seen rare, one-off legal workarounds, none have established a national law:
Brazil, 2012: A notary in Sao Paulo state registered a civil contract for a three-person union, but Brazil's National Council of Justice later clarified in 2018 that notaries should not register polyamorous unions as stable unions, effectively halting the practice as a general option.
Colombia, 2017: A triad of three men in Medellin obtained a notary agreement to cover inheritance and property rights. However, Colombian law still strictly forbids marrying more than one person. The document was a patrimonial agreement, not a marriage certificate.
The Netherlands, 2005: A trio signed a private cohabitation contract, known as a samenlevingscontract, before a notary, but Dutch civil law remains strictly limited to two-person marriages.
Canada, Ontario: Courts have recognized multi-parent families, allowing three adults to be listed as legal parents of a child for the child's well-being, but this regulates parenting rights, not spousal marriage.
2. Does Municipal-Level Only Mean It Is Illegal Outside West Hollywood?
When the West Hollywood City Council voted unanimously to establish a domestic partnership registry for three or more partners, many assumed that living in a throuple outside West Hollywood must be illegal.
That is a misconception.
Cohabiting, sharing a mortgage, raising children, and splitting rent three ways is legal across all 50 U.S. states and California. What is illegal under state law is bigamy, California Penal Code 281, the act of fraudulently obtaining a second official state marriage license while already legally married to someone else.
To avoid conflicting with state bigamy laws, West Hollywood explicitly wrote into its municipal code:
Registration does not create a marriage or registered domestic partnership under California law.
The Library Card Analogy
Think of West Hollywood's new measure like a city library card:
Inside West Hollywood: Your city card is recognized, granting you local perks and administrative privileges.
Outside West Hollywood, for example in Los Angeles, San Francisco, or Chicago: You are not a criminal, and your card is not illegal. It simply carries no administrative weight there.
3. What the West Hollywood Law Actually Changes
West Hollywood did not make polyamory legal. It was already legal. Instead, it made multi-partner relationships registrable at the city level.
The measure was approved by a unanimous 5 to 0 vote of the West Hollywood City Council on November 2, 2026, establishing a declaration process with the City Clerk.
WEST HOLLYWOOD REGISTRATION RIGHTS
- Official City Registry Certificate
- Local Hospital Visitation Rights as recognized by city facilities and programs
- Municipal Tenant Protection Rights
- City Administrative Program Access
OUTSIDE CITY LIMITS, STATE AND FEDERAL
- No Federal or State Joint Tax Filing
- No Automatic State Inheritance as a Spouse
- No Spousal Immigration Visas
- No State Divorce Court Protections for the Multi-Partner Union
West Hollywood joins progressive Massachusetts cities like Somerville and Cambridge, which expanded domestic partnership registries to three or more adults between 2020 and 2021, as well as California cities like Oakland and Berkeley, which passed non-discrimination protections for multi-partner relationships in 2024. West Hollywood's action combines local registry recognition with existing city-level family protections.
4. The Big Picture: A Stepping Stone?
For civil rights advocates, local registries represent an incremental step toward broader recognition and immediate legal protections, such as hospital visitation and rent-stabilized housing rights. However, legal scholars emphasize that unlike same-sex marriage equality—which fit into existing two-person civil frameworks—extending state or federal marriage rights to multi-partner unions faces complex legal hurdles in tax codes, property division, parental custody, and probate law that municipal registries cannot alter on their own.
The Bottom Line
Non-residents of West Hollywood can register their relationship with the City of West Hollywood because the city’s domestic partnership ordinance does not include a residency requirement. The City of West Hollywood explicitly designed its registry so that any consenting adult partners can apply, regardless of where they live or how long they have been together.
Can a man have four wives? Yes, under religious polygamy laws in roughly 58 countries, though the wives have no legal relationship to each other.
Can three or four adults be legally married as equal co-spouses under federal or state law? No country currently permits this.
Is polyamory legal in the United States? Yes, living together as a polyamorous family is fully legal everywhere in America, and in West Hollywood, you can now get official municipal paperwork to prove it.
